Mary,

I have never built with treated lumber with the intention of it swelling. I have only used it for decks, playgrounds, and such. It has been my experience that treated lumber would "swell" very little unless it where very dry when installed/assembled, and it has a constant flow of water over the parts that need swelling. In general, I have found that when I purchase treated lumber new, it is very wet and more than likely as big as it is going to get. There is a LOT of shrinkage.

If your contractor has had success with this before, I would say let the water run and see if it seals up!;-) I don't know though... sounds like from your question it isn't sealing up very fast...
